Delayed Again: NLRB Postpones Employee Rights Poster Rule

The National Labor Relations Board (NLRB) has once again delayed the implementation of a new rule requiring employers subject to its jurisdiction to post a notice informing employees of their rights under the National Labor Relations Act. The new rule is now slated to become effective April 30, 2012.

As discussed in a previous client alert, the notice was originally scheduled to take effect on November 14, 2011. Several lawsuits challenging the notice posting rule, however, had prompted the NLRB to postpone its implementation until January 31, 2012. In relation to the most recent delay, the NLRB stated that “postponing the effective date of the rule would facilitate the resolution of the legal challenges that have been filed with respect to the rule.”
