New York real property law update 2005

The following is a summary of various New York cases and legislation during the period between July 1, 2003 and June 30, 2004 of significance to real estate attorneys. This is not a summary of each and every decision of significance, or, for that matter, perhaps even what some might consider the most important developments in this area. It is a compendium of developments affecting real property law which, in the opinion of this author, practitioners are likely to encounter. The summary is divided into twelve substantive areas — vendor/purchaser, landlord/tenant, condominiums/co-ops, adverse possession, premises liability, real estate brokers, covenants and restrictions, title insurance, mortgages, recording, legislation and miscellaneous real property law.
