Ellen V. Weissman a Speaker at Top National Health Law Conference

Ellen V. Weissman, leader of the Hodgson Russ LLP Health Law Practice Group, was a speaker at the American Health Lawyers Association’s institute on Medicare and Medicaid payment issues. Held recently in Baltimore, this annual event is the premier conference for health lawyers and health care industry representatives.

Ms. Weissman's presentation, titled “Gainsharing: Structuring Incentive Payment and Shared Savings Programs,” addressed the importance for hospitals of implementing gainsharing programs, which utilize the sharing of cost savings attributable to physicians’ efforts in controlling the costs of providing patient care. She was joined by a co-presenter from the national Centers for Medicare and Medicaid.

Topics included legal constraints in structuring gainsharing programs, including federal and state regulations; recent legal developments, including favorable advisory opinions from the Office of Inspector General and proposed exceptions to Stark regulations governing physician self-referrals; and what hospitals can do now to design a gainsharing program given the existing legal constraints.
