Health Law Ellen Weissman on Incentive Payment and Shared Savings Programs at National Health Law ConferenceMarch 23, 2010 Ellen V. Weissman, leader of the Hodgson Russ LLP Health Law Practice Group, will be a speaker at the American Health Lawyers Association’s institute on Medicare and Medicaid payment issues, to be held March 24-26, 2010, in Baltimore. This annual event is the premier conference for health lawyers and health care industry representatives. Ms. Weissman’s presentation, titled “Structuring Incentive Payment and Shared Savings Programs,” will address how hospitals and physicians may work together to surmount legal impediments to structuring incentive payment programs that use cost savings attributable to physicians’ efforts in controlling the costs of providing patient care. She and her co-speaker, Mark Wynn of CMS, will also be addressing Medicare Demonstration Programs and initiatives authorized by the newly enacted federal health care reform bill. Topics will include legal constraints in structuring gainsharing, incentive payment, and shared savings programs, including federal and state regulations; recent legal developments, including favorable advisory opinions from the Office of Inspector General and proposed exceptions to Stark regulations governing physician self-referrals; what hospitals can do now to design a program given the existing legal constraints; and how federal health reform will impact these types of programs.
