More PERM Audits On The Horizon
The U.S. Department of Labor (DOL) recently released information demonstrating that an increased number of Labor Certification applications ("PERM" applications) are being audited. As of December 31, 2007, 44 percent of the 23,000 pending PERM cases were in "audit review," meaning a PERM center analyst has additional questions about the information in the application, and will be asking the employer for further explanation. This is a significant increase from the 11 percent of PERM applications being audited when the DOL last updated its statistics in June of 2007. The increase in audits means PERM applicants must be very careful in thoroughly documenting their compliance with all requirements of the application process.
