New Format for Documentation of Nonimmigrants Applying for Visas at Embassies and Consulates Abroad

The U.S. Department of State (DOS) has amended its process for applying for a nonimmigrant visa to the United States. Current processes require applicants for nonimmigrant visas to file electronic form DS-156 online with the DOS, then print, sign, and bring the completed form to their visa interview. Effective April 29, 2008, DOS will begin accepting form DS-160 in lieu of form DS-156. Form DS-160 is an electronic form that must be filled out and signed electronically. All information entered on form DS-160 will be available to consular officers at the time of the applicant's interview, negating the applicant's need to print and physically sign the form. Passports and biometrics collected as part of the application process will identify the applicant to the consular officer.

Although the DOS may eventually eliminate the DS-156 form altogether, at this time it will continue to accept applications using either form DS-156 or form DS-160.

Attorneys may continue to assist applicants in the preparation of form DS-160, but nonimmigrant applicants will be required to electronically sign the application themselves. Applicants must continue to identify any third parties assisting in the preparation of the application. Applications for aliens under the age of 16 or who are physically incapable of signing may be completed and executed by a parent or guardian.
