New vaccination requirements for immigrant visa and adjustment of status applicants
Immigrant applicants have long been required to submit evidence of certain vaccinations during the immigrant visa application process. New vaccines added in 2007 to the list of those required include:
Rotavirus (for children ages two months to six months) Hepatitis A (for children ages 12 months to 23 months) Meningococcal conjugate (MCV4 or MPSV) (for children ages 11 to 18) Human papillomavirus (HPV) (for females ages 11 to 26) Zoster (for persons age 60 and older)
In addition, the Hepatitis B vaccine is required for all persons through 18 years of age, and influenza vaccines are required for children age six to 59 months and adults age 50 and older. Acellular pertussis-containing vaccines are now available for all people age 10 and older, and are given as a single (booster) dose for persons 10 through 64 years of age who have completed the recommended childhood diphtheria and tetanus toxoids and the pertussis/diphtheria and tetanus toxoids and acellular pertussis vaccine series.
Applicants for immigrant visas or adjustment-of-status to legal permanent resident must submit proof of vaccinations from a USCIS-certified panel physician or civil surgeon. Those vaccinations required based on the applicant's age must be administered, unless a waiver is obtained. Waivers are available when (1) an individual received a vaccination but does not have documentation, (2) a vaccination would not be medically appropriate, or (3) in some instances, when a person's religious beliefs or moral convictions do not support vaccination. Refugees and asylees are not required to submit to vaccination requirements unless they apply to adjust status. Certain other circumstances can also allow for a waiver of the vaccination requirements.
Please contact a Hodgson Russ immigration professional with any questions regarding current vaccination requirements or waivers.
