Invariably, when an employer is served with an administrative complaint or lawsuit pertaining to an employee’s discrimination or harassment claims, document production requests will be made when the proceeding commences. An employer’s ability to produce documentation that supports the business judgments and the actions that the employer has made and taken regarding the complaining employee can be a vital factor in establishing a viable legal defense.
