Represented EPL Insurer in Lawsuit Against CGL Insurer for Defense Cost Reimbursement

After a commercial general liability (CGL) insurer offered to pay only a tiny portion of a policyholder’s defense costs, the policyholder’s employment practices liability (EPL) insurer stepped up and paid for the defense. The EPL insurer then retained Hodgson Russ to sue the CGL insurer for reimbursement. In a case that went all the way to the New York Court of Appeals, Hodgson Russ won reimbursement of half the defense costs the client had paid—far more than the CGL insurer had offered.
