The NYS Brownfield Cleanup Program (“BCP”) offers significant financial and practical benefits allowing for the redevelopment of otherwise blighted properties, which can often be the difference between a redevelopment project being viable. In this presentation, we will offer a comprehensive overview of the BCP from start to finish. This review will cover the initial stages of working with the New York State Department of Environmental Conservation (“NYS DEC”) to gain admission into the BCP, to the final stages of working with the NYS Tax Department to claim the applicable tax credits, as well as everything in between.
