Garry M. Graber and Catherine Grantier Cooley were speakers at the sixth annual Western New York Bankruptcy Conference, presented on May 15, 2009, by the Erie Institute of Law/Bar Association of Erie County and the Monroe County Bar Center for Education.
Garry’s presentation, titled “Trends in Debtor-in-Possession Financing,” covered recent developments in this type of financing arranged by companies while in the chapter 11 bankruptcy process.
In “Electronic Discovery in the Bankruptcy Case,” Cathi discussed the unique ways in which electronically stored information (ESI) is used in bankruptcy cases. In addition to its traditional discovery uses, ESI is an asset of the bankruptcy estate, to be preserved, protected, and, if appropriate, valued for purposes of sale. Cathi's presentation also addressed important considerations regarding which party should pay the cost of e-discovery in the bankruptcy court.
