The United States Department of Justice recently issued a memorandum to federal prosecutors nationwide making clear that the government is refocusing and sharpening efforts to pursue individuals as part of white collar investigations, prosecutions and civil enforcement actions. There is a renewed, more aggressive approach to investigations, with a focus on individuals specifically.
The Yates Memorandum changes the playing field for both companies and non-profits, their owners, executives, managers and individual employees in avoiding, managing and handling both internal and government investigations. Federal, state and local white collar enforcement and regulatory trends will be discussed including:
