The Governor Signs Fiscal Intermediary Legislation

On December 18, 2017 NY Governor Andrew Cuomo signed Assembly Bill A.7216/Senate Bill S.5544 into law, which implemented the Fiscal Intermediary Authorization requirements.  The legislation grants entities operating as fiscal intermediaries prior to April 1, 2017 a period of one year (until January 1, 2019) to obtain authorization from the State Department of Health.  In its August 2017 Medicaid Update, the Department stated that it would provide an update outlining how the extension would impact implementation of the FI authorization process.  As the application deadline has passed, it is unclear how the Department will now adjust the Authorization process.  We expect that the Department will provide an update clarifying its next steps within the next few weeks, and we will circulate a follow-up alert at that time.
