The State’s Highest Court Affirms the 13-Hour Rule

Home Care Alert
March 26, 2019

The New York Court of Appeals, the State’s highest court, just released its long-awaited decision in the “live-in” litigation that has dragged on for the last several years. This is a win for home health care providers that have for decades relied on the NYS DOL’s 13-hour rule to compensate their aides working 24 hour shifts. We are currently reviewing this opinion and will issue a complete summary of the decision and its implications later today.
