Hodgson Russ Partner Timothy Noonan was quoted in the Tax Notes article, “Federal Suit Highlighting Judge Shortage at NYC Tribunal Is Withdrawn.” When asked about the case, Noonan noted “that the lawsuit was filed at a time when there wasn’t an ALJ available to handle cases. The lawsuit had an excellent argument that no such remedy existed. But shortly after the filing of the lawsuit, the city hired one administrative law judge, so theoretically at that point the taxpayer had at least some ability to seek a remedy in the city tax tribunal.” He added that he didn’t know the specific circumstances of why the case was withdrawn, there is still only one ALJ in the tribunal, that cases still aren’t moving, and the backlog of cases is growing by the day.”
