There’s still hope for Edward Zelinsky and his fight against New York State’s “convenience of the employer rule.”

The case is known as Zelinsky II, and it’s one Hodgson Russ Partners Tim Noonan and Open Weaver Banks have been closely monitoring for years. Zelinsky, a Cardozo School of Law professor, is challenging the NYS Department of Taxation and Finance’s (DTF) ruling surrounding the taxation of income he earned while working from his home in Connecticut during remote working requirements through the COVID-19 pandemic.

Tim and Open examine why, despite sustaining two recent setbacks in his challenges, Zelinsky still has a good chance of prevailing and obtaining a victory on appeal.
