Art has practiced employee benefits law since 1986, and his extensive experience covers all aspects of the field. He advises clients on risk management and administrative matters and regularly assists clients in the design and documentation of employee benefit plans. His clients include group insurance brokers and consultants, plan sponsors, employee benefit plan trustees, custodians, retirement plan record keepers, and investment advisory firms. Art also represents plan sponsors in litigation involving fiduciary and benefits claims.

A growing part of Art’s practice involves the provision of legal services in connection with employer-sponsored health and welfare benefit plans, including self-insured group health plans (medical, dental, and prescription drug plans), cafeteria plans, health reimbursement arrangements (HRAs), health savings accounts (HSAs), and employee benefit trusts (e.g., voluntary employee benefit associations [VEBAs] and group insurance trusts [GITs]).

Specific services offered in relation to these plans include the following: 

  • Preparation of Employee Retirement Income Security Act (ERISA) plan documents and summary plan descriptions (SPDs)
  • Preparation of Consolidated Omnibus Budget Reconciliation Act (COBRA) policies and procedures
  • Preparation of Health Insurance Portability and Accountability Act (HIPAA) privacy and security policies and procedures
  • Preparation/review of third-party service provider agreements (e.g., self-insured administrative service agreements)
  • Advice in connection with disputed claims and subrogation claims
  • Advice regarding Form 5500 filing requirements, including preparation of delinquent filer voluntary compliance (DFVC) filings
