Hodgson Russ Successfully Defends Licensed Hemp Retailer Against 22 Counts of Violations in NYC
Hodgson Russ successfully defended a licensed hemp retailer against twenty-two counts of violations for allegedly selling flavored vapes and e-cigarettes.
The New York City Department of Consumer and Worker Protection issued a summons and violation against our client, charging the establishment with over 20 counts of selling flavored vapes, selling e-cigarettes without the appropriate license, and not having the correct signage indicating sales are only to persons over 21 years of age.
By arguing that New York State Cannabis Law preempts the New York City code as it pertains to hemp, Hodgson Russ successfully reasoned that the establishment, which was solely selling hemp products, was legally operating within the bounds of the Cannabis Law, and under the Cannabis Law, all such activities were permissible and legal.
Hodgson Russ obtained a full dismissal of all violations.
