Statutory and Case Law Update

Daniel Spitzer presented the “Statutory and Case Law Update” at the Southern Tier West Local Government Conference, which was hosted at Houghton University n June 5, 2025. 

His session was spent discussing the Green Amendment, the Climate Leadership and Community Protection Act, and the public utility variance standard. Dan discussed numerous court decisions on renewable energy and SEQRA. He also reviewed major recent developments and provided guidance on implementing changes in the law.

The Southern Tier West Regional Planning & Development Board (STW) is the regional planning agency for Allegany, Cattaraugus, and Chautauqua Counties in Western New York. STW assists 124 towns and villages in a diverse set of topics, including community and economic development, community planning, data and information services, environmental and energy planning, regional services, local food planning, local government and community assistance, and water source management.
