New York Piggybacking Provision Extended for Another Year
Following up on our June 16 alert, “New York Piggybacking Provision Extension Advances to Governor’s Desk,” the piggybacking extension advanced by Legislative Bill S.10075-A/A.11162-A has officially been signed into law by Governor Hochul as of June 29, 2026. The new law ensures that piggybacking will remain a permissible alternative to the public bidding process for another year. This latest extension will expire on June 30, 2027.
This positive development comes on the heels of a significant recent ruling in the Third Department, which prohibited the use of piggybacking for capital project work, as discussed in our prior alert. Although the legislation granting the extension does not address the implications of the Third Department’s decision, extending the state’s piggybacking will continue to promote efficiencies and reductions in administrative costs in the procurement of goods and services. Government entities utilizing piggybacking arrangements must, however, still ensure that they vet these proposed arrangements appropriately and utilize piggybacking in a manner consistent with the requirements and limitations of the General Municipal Law.
